Release of Liability and Waiver, Assumption of Risk and Indemnification

I,  acknowledge that I wish to become a member of BENA USA by application and consideration to BENA USA. I attest that I have read, fully understand, and agree with the following representations and conditions of membership or association of any kind with BENA USA:

I am aware of the non-refundable financial obligations contractually for 1 year periods, that will auto-renew in like form without 60 days prior written notice of the 1 year anniversary date.  I attest that I fully understand all risks of participating in the program/activities, services, purchased products, and attended events.  I understand and still hold harmless BENA USA whether the prior indicated is provided by BENA USA or provided by any 3^rd party, independent contractor, company or employee whether a product or service as I assume all risks, foreseeable and unforeseeable, in any way connected with my participation herein. I am aware that BENA USA is not responsible for any lost, stolen, or damaged valuables or property at any associated event. I am aware that BENA USA is not responsible for any personal or business losses past, current or future, based on advice, sale, consultation, or the like provided by any associated party of BENA USA.

I agree not to institute any claims or legal action against BENA USA for any claim released by this Agreement.

I affirm and agree by application, or consideration, or membership of BENA USA to protect, defend, and indemnify BENA USA, and any of its employees or Founders, vendors, associated parties providing any products or services through; referred, branded by BENA USA or products or services provided by BENA USA in regards to any claim or expenses (including attorneys’ fees, claims by a third party or otherwise, that might be made on my behalf) in any way connected with a claim related to my participation as a Member, Company or as an Individual.

I have read and fully understand, agree to, and accept voluntarily all provisions of this Release of Liability and Waiver, assumption of Risk, and Indemnification.

This release will be governed by and construed in accordance with the laws of the State of Texas and venue for all challenges of this waiver shall be restricted to the federal or state courts located within Montgomery County, Texas.

I am signing this Agreement freely, voluntarily, and competently and I am at least eighteen (18) years of age.  I agree to the electronically signing by reading, checking the box affirming that I read in full and agree.
